Federal Supreme Court decision concerning the water rights concession for the use of the hydropower of the Färdabach (1C_401/2020 of March 1, 2022):
“In addition, due to climate change, a decline in glacier and snowmelt water is to be expected, meaning it is not guaranteed that the currently observed surpluses (i.e., flow rates above the designed flow capacity of 750 l/s) will continue to occur in the future (throughout the entire 80-year concession period).” (Section 6.4)

The Federal Supreme Court is changing its case law on the protection of existing buildings in watercourse areas. Non-conforming buildings outside of designated building zones in watercourse areas may neither be expanded nor rebuilt, because doing so would reinforce the unlawful status under water law and perpetuate it beyond the lifespan of the originally approved structure (BGer 1C_22/2019, 1C_476/2019 vom 6. April 2020, E. 9.2).
